(“QuickTake,” the “Company,” “we,” “our,” or “us”) is a health technology company pioneering self-service kiosk automation for senior living communities, athletic programs, health clubs and care providers. We use medical-grade measurement technology with engaging digital experiences, to provide seamless and simplified processes for review, evaluation, diagnosis and treatment of your health. This Privacy Policy describes the types of information we may collect from you (“you”, “your”, or “User”, and together with other users of the Kiosk, “Users”) when you use our QuickTake automated self-service kiosk (the “Kiosk”), the QuickTake website located at www.quicktakehealth.com (the “Website”), the QuickTake application (the “App”), and any other products or services provided or operated by QuickTake (such products or services, together with the Kiosk, Website, and App, are collectively referred to as the “Services”) and our practices for how we use and store that information, with whom we share it, what rights you have regarding your information and how to contact us to exercise these rights.
This Privacy Policy applies to all Personal Data and other information we collect about you or that you may provide us in connection with your access and use of the Services, including without limitation communications (including texts, emails, chat, QR codes, and other electronic messages) between you and the Services in which you may provide Personal Data to QuickTake (defined below).
This Privacy Policy does not apply to: (1) information collected by any third party, including any third-party link that may be accessible from our Services, and (2) any third-party software or applications that integrate with our Services.

For example, QuickTake and/or our customers may use software to organize and summarize the health information that we collect when you use the Kiosk to generate a report that is then provided to your health care provider.
We use facial recognition technology to securely identify you and ensure your Personal Data is linked to the correct medical record when using the Kiosk.

We are not responsible for, and do not use your information to, evaluate, diagnose or treat your health. The Kiosk and any related Services are intended to facilitate wellness monitoring and should not be used to replace evaluation, diagnosis or treatment by a licensed healthcare provider. Your medical institution and/or healthcare provider is solely responsible for the processing of your personal data for the provision of your medical treatment and care.
We may share aggregated information about our Users, and information that does not identify any individual, without restriction. For example, we may remove personally identifying information (“de-identify”) from aggregate health information about many Users, including you, such that the information may be used without identifying the specific individuals involved, and then use and disclose such de-identified aggregate information for any lawful purpose, including improving and expanding our Services. We may sell, license, disclose, and/or transfer such de-identified aggregate information, or any studies, analyses, or conclusions we make from it, for profit or otherwise, to any third parties, including potential and actual customers, business partners, investors, lenders, and advisers.

Without limiting Section 9 above, you acknowledge and agree that in order to use certain Services, we are required to collect your Biometric Data (as defined below). Specifically, you acknowledge and agree that when interacting, accessing or using the Kiosk, QuickTake will collect, capture, receive, or otherwise acquire your Biometric Data.
QuickTake may collect, use, disclose, and otherwise process your Biometric Data as necessary to facilitate health wellness and for the purposes described in Section 4 above (collectively, “Permitted Purposes”). In furtherance of these Permitted Purposes, QuickTake may also disclose your Biometric Data to our third-party service providers and to your physician or other health care provider, as described in Section 5 above. You consent to QuickTake’s collection, use, and storage of your Biometric Data for the Permitted Purposes and for any other purpose that you specifically consent to.
QuickTake may retain your Biometric Data as long as is necessary or relevant for the Permitted Purposes, which shall in no event exceed the date on which a User terminates their account and is no longer a registered User of the Services, unless we are otherwise required by law to retain such information for a longer period.

As part of providing the Services, QuickTake collects certain demographic, health, and/or health-related information about Users that may be considered “protected health information” (“PHI”) and is therefore subject to the laws and regulations governing the use and disclosure of PHI. The Health Insurance Portability and Accountability Act (“HIPAA”), the Health Information Technology for Economic and Clinical Health of 2009 (“HITECH”), along with the regulations adopted under those statutes, and similar state laws (where those laws are more stringent than HIPAA) govern the handling of PHI. Specifically, when (a) QuickTake, acting as a “Business Associate” (as that term is defined in HIPAA) receives certain demographic, health and/or health-related information about a User from or on behalf of a “Covered Entity” (as that term is defined in HIPAA), or (ii) QuickTake, acting as a Covered Entity, shares or discloses certain demographic, health, and/or health-related information about a User to a Business Associate, this information is considered PHI.
Personal Data that a User provides to QuickTake outside of the foregoing context is not PHI. For example, when you (a) use the Website’s or App’s interactive tools and services, (b) voluntarily provide information in free-form text boxes through the Website, App, or through responses to surveys and questionnaires, (iii) provide us with device/IP address information or other technical information by visiting our Website or using our App, or (iv) send us an email or otherwise contact us directly, that information is not PHI.
HIPAA provides specific protections for the privacy and security of PHI and restricts how PHI is used and disclosed. QuickTake may only use and disclose PHI in the ways permitted by HIPAA or as authorized by the User.
If you share your computer, you should log out and close your browser window after visiting the Website. This will help protect the confidentiality of your Personal Data.
You may create and register an account with QuickTake when using any of the Services. You agree to accept responsibility for all activities that occur under your account or password. You agree to notify QuickTake immediately of unauthorized use of your account or any other breach of security. We may refuse service, terminate accounts, or remove or edit content at our sole discretion.
QuickTake uses reasonable physical, electronic, and administrative safeguards to help protect the security, integrity, and confidentiality of data collected from the Kiosk, Website and App and stored in the cloud.
Except as specified in this Privacy Policy, we use commercially reasonable efforts to limit access to Personal Data to employees, third-party contractors, and authorized personnel of QuickTake who need Personal Data in order to perform their duties, and who are bound by BAAs or other legal obligations to keep Personal Data confidential and use it only for the purposes for which we disclose it to them.
We implement industry-standard security protocols, including data encryption, firewalls and intrusion detection systems. While no system is 100% secure, we believe that the measures we have implemented minimize the risk of a security breach to an appropriate level given the types of Personal Data involved. Please note that Personal Data you provide by email is unencrypted.
You agree that any transmission of Personal Data is at your own risk and acknowledge that transmission of Personal Data via the internet and to the cloud server is not completely secure and, that, although we will endeavor to protect your information, we cannot guarantee the security of Personal Data transmitted to the cloud. Once we have received your information, we will use reasonable procedures and security features to try to prevent unauthorized access.
The California Consumer Privacy Act (“CCPA”) provides California residents with specific rights regarding their Personal Information, as that term is defined below. We will ask for information allowing for verification that you are the person about whom we collected Personal Information and will use that information only for that purpose. We may request that you submit a signed statement that you are the individual you claim to be. We cannot respond to your request or provide you with Personal Information if we cannot verify your identity and confirm that the Personal Information relates to you. We will acknowledge receipt of your request and will endeavor to respond within forty-five (45) days of receipt of your request. If we require more time, we will notify you of our need for additional time and may take up to an additional forty-five (45) days. We cannot respond to your request or provide you with Personal Information if we cannot verify your identity and confirm that the Personal Information relates to you.
You may make a request for disclosure of our information collection practices, the information we collected about you, or our information sharing practices twice within a twelve (12) month period, and you may make a deletion request at any time. We will attempt to respond within forty-five (45) days of receipt of your request, but if additional time is required, we will notify you and may take up to an additional forty-five (45) days.
For requests for a copy of Personal Information we have collected during the previous twelve (12) months prior to your request, we will attempt to provide the information in a format that is readily useable, including by mailing you a paper copy or providing an electronic copy to you.

We are not required to comply with a request to delete information if the information is necessary for us to detect, protect against, or prosecute security incidents, fraud, or illegal activity and to comply with legal obligations.

We may disclose Personal Information to certain third parties as described in this Privacy Policy, as well as to our affiliates and partners who provide us with services such as helping QuickTake with advertising, data analysis, and security. This assistance may fall under the definition of “consideration” and be considered a “sale” under the CCPA. This includes identifiers, protected classifications under California or federal law including age (40 years or older) and medical condition, commercial information, internet or other similar network activity, and/or geolocation information, and other information as listed below.
